Universal Consultation Terms and Conditions

Effective Date: August 3, 2026

These Universal Consultation Terms and Conditions apply to every consultation scheduled with BY ABP LLC, regardless of the collection, package, standalone service, custom proposal, promotion, giveaway, gifted service, complimentary offering, or TFP arrangement being discussed.

By scheduling a consultation, submitting an intake form, or selecting the required acknowledgment, the person scheduling the appointment confirms that they have read, understood, and agreed to these terms.

1. Purpose of the Consultation

A consultation allows BY ABP LLC and the prospective client to discuss the requested photography services, vision, priorities, date, location, participant count, timeline, intended image use, privacy needs, logistical requirements, available collections, pricing, and possible next steps.

Information discussed during the consultation is preliminary. Recommendations, pricing, availability, coverage, deliverables, and proposed services may change after BY ABP LLC reviews the complete project scope.

Scheduling or attending a consultation does not create a photography services agreement, reserve a date, or require BY ABP LLC to accept the requested project.

2. Project Review and Acceptance

BY ABP LLC reserves the right to accept or decline a requested project based on factors that may include:

  • Availability

  • Requested date and location

  • Service scope

  • Participant or guest count

  • Intended image use

  • Safety concerns

  • Travel or logistical requirements

  • Permit or licensing requirements

  • Venue or property restrictions

  • Government rules or access limitations

  • Equipment requirements

  • Timeline feasibility

  • Whether the request falls within the services offered by BY ABP LLC

A consultation appointment does not guarantee that BY ABP LLC will provide a proposal or accept the project.

3. Reservation of Services

A date is not reserved until all applicable booking requirements have been completed.

Booking requirements may include:

  • Written confirmation of availability from BY ABP LLC

  • Approval of the final project scope

  • Acceptance of the written proposal

  • Signing of the required photography services agreement

  • Completion of applicable TFP or promotional agreements

  • Selection of the applicable privacy option

  • Completion of required participant consent forms

  • Receipt of all required retainers or booking payments

Consultations, intake forms, proposals, estimates, verbal discussions, text messages, emails, and social media messages do not reserve a date.

Until every required booking step is completed, BY ABP LLC may accept another client for the requested date.

4. Authority to Schedule and Book

The person scheduling the consultation confirms that they are authorized to discuss the requested project and provide the information submitted through the scheduling system.

The person who later signs the photography services agreement must have authority to approve the services, accept financial responsibility, and enter into the agreement for themselves or the applicable client group.

When another person, business, organization, representative, or decision-maker must approve the project, that requirement must be disclosed before booking.

5. Accuracy of Client Information

The client confirms that all information provided to BY ABP LLC is accurate and complete to the best of their knowledge.

BY ABP LLC may rely on the information provided when evaluating the project and preparing recommendations, pricing, proposals, timelines, location plans, and service agreements.

The client must promptly disclose any material change involving:

  • Date or time

  • Location

  • Participant or guest count

  • Minors or animals

  • Coverage needs

  • Timeline

  • Intended image use

  • Privacy requirements

  • Accessibility or accommodation needs

  • Permits or restrictions

  • Travel requirements

  • Safety concerns

  • Requested services or add-ons

BY ABP LLC is not responsible for limitations, delays, missed coverage, inaccurate pricing, additional charges, or complications caused by incomplete, inaccurate, outdated, or withheld information.

6. Consultation Scheduling

Clients should arrive, call, or join the consultation at the scheduled time.

Late arrival may result in a shortened consultation. Additional time is not guaranteed because other appointments may follow.

Clients should provide at least 24 hours’ notice when canceling or rescheduling a consultation whenever reasonably possible.

Missed consultations and repeated last-minute cancellations may require the client to schedule another appointment according to current availability.

BY ABP LLC may reschedule a consultation because of illness, emergency, technical difficulties, unsafe conditions, scheduling conflicts, or circumstances outside its reasonable control.

7. Pricing and Proposals

Prices discussed during a consultation are based on the information available at that time.

Pricing may change when the client changes or adds any material project detail, including:

  • Date or location

  • Coverage time

  • Participant or guest count

  • Additional locations

  • Deliverables

  • Privacy requirements

  • Travel

  • Permits

  • Staffing

  • Intended commercial use

  • Timeline or access requirements

  • Add-ons or enhancements

Only a written proposal and signed photography services agreement issued by BY ABP LLC establish the final services, deliverables, pricing, payment schedule, responsibilities, and limitations of the parties.

Unless expressly approved in writing, services and package benefits have no cash value and may not be transferred, exchanged, divided, substituted, resold, or applied to another service.

8. Complimentary, Promotional, Giveaway, and TFP Services

TFP refers to an approved arrangement in which photography services are provided without the standard base-service payment in exchange for agreed participation, cooperation, portfolio-building value, promotional authorization, image-use rights, or other written consideration.

When BY ABP LLC offers a complimentary service, giveaway, promotion, gifted service, or TFP arrangement, only the specific base service identified in writing is complimentary.

The complimentary portion does not include upgrades, add-ons, expenses, or additional services unless those items are expressly included in writing.

Separate charges may apply to:

  • Additional photography time

  • Additional locations

  • Additional photographers or assistants

  • Additional edited photographs

  • Candid Polaroids or approved physical products

  • Rush delivery

  • Hair and makeup

  • Travel and lodging

  • Transportation, parking, and tolls

  • Permits, licensing, or admission

  • Venue, courthouse, property, or access charges

  • Delayed Sharing or Complete Privacy

  • Commercial image licensing

  • Additional editing outside the included service

  • Applicable taxes and processing charges

  • Any other service outside the approved base offering

All additional services must be approved by BY ABP LLC and paid as required before those services are provided.

BY ABP LLC is not required to provide an unpaid addition merely because it is requested during the consultation, after booking, or on the service date.

A separate TFP, promotional, giveaway, participant-consent, or image-use agreement may be required.

9. Taxes, Permits, Fees, and Expenses

The client is financially responsible for all applicable taxes and project-related expenses unless a written proposal expressly states otherwise.

Client-responsible expenses may include:

  • Photography permits

  • Business or commercial-use permits

  • Licenses

  • Government charges

  • Venue or courthouse charges

  • Admission and access fees

  • Parking, valet, and tolls

  • Transportation and lodging

  • Travel expenses

  • Location or property fees

  • Insurance documentation

  • Additional-insured endorsements

  • Processing or transaction fees

  • Customs or international charges

  • Third-party service expenses

This responsibility applies to charges imposed at the federal, state, county, municipal, venue, property, association, agency, or other applicable level.

When BY ABP LLC advances an approved expense on the client’s behalf, the client must reimburse BY ABP LLC by the written payment deadline and before the affected services are provided.

10. Permissions and Legal Requirements

The client is responsible for obtaining and maintaining all permissions, reservations, appointments, authorizations, permits, licenses, admissions, releases, and approvals required for the requested photography services.

Requirements may be imposed by:

  • Courthouses and government offices

  • Wedding or event venues

  • Parks and beaches

  • Private property owners

  • Hotels and resorts

  • Religious institutions

  • Homeowners’ associations

  • Gyms or fitness facilities

  • Transportation providers

  • Event organizers

  • Local, state, federal, or international authorities

The client is responsible for confirming venue rules, photography restrictions, guest limitations, identification requirements, security procedures, operating hours, access conditions, and applicable deadlines.

BY ABP LLC may request written proof of permission, approval, reservation, or permit before accepting or performing the affected services.

When required permission or access has not been obtained, BY ABP LLC may modify, relocate, delay, or decline the affected portion of the project.

11. Professional Scope and No Legal Advice

BY ABP LLC provides professional photography services and photography-related planning guidance.

BY ABP LLC is not a law firm, tax professional, financial adviser, government agency, permit authority, marriage-license authority, immigration adviser, insurance professional, safety inspector, or medical provider.

Information concerning permits, licenses, taxes, contracts, government requirements, venue policies, insurance, accessibility, travel documents, or legal obligations is provided only as general logistical guidance.

The client is responsible for contacting the appropriate government office, venue, property owner, attorney, accountant, tax professional, insurance professional, medical provider, or other qualified authority when advice outside the professional scope of BY ABP LLC is required.

12. Third-Party Services

BY ABP LLC may recommend or coordinate with beauty professionals, venues, officiants, planners, travel professionals, permit offices, rental providers, or other third parties.

A recommendation does not create an employment, partnership, agency, or joint-venture relationship between BY ABP LLC and the third party.

Third-party providers operate independently and remain responsible for their own:

  • Availability

  • Pricing

  • Agreements

  • Payments

  • Policies

  • Conduct

  • Licensing

  • Insurance

  • Services and performance

La Mariée Beauty is independently owned and operated. Its availability, services, contracts, payments, policies, and pricing are handled separately by La Mariée Beauty.

When company travel arrangements are required, travel is handled through Revelle Travel unless BY ABP LLC approves a written exception.

BY ABP LLC is not responsible for third-party delays, cancellations, errors, restrictions, service failures, conduct, or additional expenses.

13. Access, Safety, and Photography Restrictions

Photography is subject to applicable venue rules, property restrictions, government requirements, security procedures, access limitations, timing restrictions, and instructions from authorized representatives.

BY ABP LLC cannot guarantee access to a specific room, area, person, ceremony, document, activity, or moment when access is limited by another party or by circumstances outside BY ABP LLC’s control.

Weather, traffic, delays, security procedures, venue rules, restricted access, guest interference, unsafe conditions, and timeline changes may affect the photographs that can reasonably be created.

BY ABP LLC may refuse, pause, relocate, modify, or end photography when safety, legal compliance, equipment protection, permit compliance, or location rules are at risk.

Lasers may not be used or activated anywhere near the photography area while BY ABP LLC is photographing.

14. Participant Consent and Privacy Options

Every participating adult and the parent or legal guardian of every participating minor may be required to complete a consent form before photography begins.

The rights granted through the consent forms must match the privacy option purchased for the service.

Available privacy structures may include:

  • Standard Image Use

  • Delayed Sharing

  • Complete Privacy

Complete Privacy authorizes participation and photography only. It does not grant BY ABP LLC promotional, portfolio, advertising, publication, competition, award-submission, or other public image-use rights.

Incomplete consent forms may prevent or delay photography. The specific consequences will be stated in the applicable photography services agreement.

15. Final Photography Services Agreement

These consultation terms do not replace the photography services agreement required for an accepted project.

The final photography services agreement may contain additional provisions concerning:

  • Retainers and payments

  • Cancellations and rescheduling

  • Travel

  • Weather

  • Illness

  • Safety

  • Coverage limitations

  • Editing

  • Image selection

  • Gallery delivery

  • Copyright and licensing

  • Personal or commercial use

  • Privacy

  • Participant consent

  • Archival periods

  • Limitation of liability

  • Dispute resolution

When these consultation terms conflict with a later signed photography services agreement, the signed photography services agreement controls for the booked services.

16. Electronic Acceptance

Selecting the required acknowledgment, submitting the intake form, or completing the consultation booking confirms the client’s agreement to these Universal Consultation Terms and Conditions.

The client confirms that they had an opportunity to review these terms before completing the scheduling process.

17. Severability

If any provision of these terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

18. Governing Law and Venue

These Universal Consultation Terms and Conditions are governed by the laws of the State of California.

To the extent permitted by law, any dispute relating to these consultation terms will be brought in a court of appropriate jurisdiction located in San Diego County, California.
